When did the Asbestos Work Regulations come into place and what are they?

The Control of Asbestos at Work Regulations came into effect on the 21st November 2002 and introduced an explicit duty to manage asbestos in premises.

The duty to manage requires those in charge of premises to:

  • Find out if there is asbestos in the premises, its amount and condition;
  • Presume materials contain asbestos unless there is strong evidence that they do not;
  • Make and keep an up to date record of the location and condition of the ACM’s or presumed ACM’s in the premises;
  • Assess the risk from the materials;
  • Prepare a plan setting out how the risks from materials are to be managed;
  • Take the necessary steps to put a plan into action
  • Review and monitor the plan periodically; and
  • Provide information on the location and condition of the materials to anyone liable to work on or disturb them.

The 18 month lead in period of this legislation will see the regulations coming in to effect in May 2004.
